These are the full Terms and Conditions for the customers’ use of this website and for the purchasing of products through this website. Please read these carefully. If you do not agree to these Terms and Conditions please do not use this website.

This website is owned and operated by Cherry Tree Trading and is registered in England and Wales. Use of this website and information on this website is subject to the terms and conditions set out in this document. By using this website you are acknowledging your consent to be bound by these terms and conditions. We reserve under sole discretion the right to change these Terms and Conditions at any time without notice. Any changes will be posted within this document. By use of this website you accept that you are bound by these terms and conditions as they are written in this document. This document should be checked regularly by customers using this website.

Pricing

All prices on this website are in £ sterling and include VAT where appropriate. 
We make every effort to ensure the prices on this website are correct, however errors may occur and we reserve the right to alter product prices on this website without notice. In the event that we change the price of an item due to an error we will inform the customer as soon as possible of the amendment and the correct process. The customer may choose to fulfil their order at the correct price or to cancel the order. If you choose to cancel your order and goods have already been paid for we shall refund the full amount in accordance with these terms and conditions. The customer should be aware that a pricing adjustment due to a promotion, sale or other offer is not considered an error in price and therefore the above terms and conditions do not apply. Cherry Tree Trading is under no obligation to fulfil an order for a product that was advertised at an erroneous price.

Availability
The purchase of all products displayed on this website is subject to availability. Please be aware that some product packaging, styles and colours may vary. As an order is processed we will inform you by e-mail if any items you have ordered are out of stock. You have a right to cancel your order at this point or you can choose to keep the order on hold until the product comes back into stock. We will keep you reasonably updated on the status but should you wish to cancel during this period you may do so.

We charge your credit/debit card at the point of order as a form of commitment from the customer and to ensure our financial systems are manageable.

Acknowledgment of order
When an order is completed online we will send an e-mail confirming the purchase, cost, p&p and delivery and invoice details. Your order represents an offer to us to purchase a product; once the order has been dispatched a binding agreement between both parties will exist.

Delivery and shipping

Product prices on this website are exclusive of delivery and shipping charges. Shipping charges are £2.95 UK mainland and £19.95 overseas per order. We will endeavour to deliver products to the customer as soon as possible. All deliveries will be made to the address that you give for delivery of products. You should be aware that when goods are shipped internationally they are subject to opening and inspection by custom authorities. Please allow up to 7 days for your order to arrive from date of dispatch. If this time elapses please contact us on 01253 347611 where we will be happy to assist in the tracking of the order. Please be aware if you do not contact us within 30 days in relation to a lost package an insurance claim cannot be made and thus you will be unable to claim any loss from us and you will not be entitled to a refund.

Cancellations
Under the Consumer Protection (Distance Selling) Regulations you have the right to cancel your order at any point up to dispatch and up to 7 working days after receipt of delivery of goods. A ‘working day’ means a Monday, Tuesday, Wednesday, Thursday or Friday that is not a public holiday. In the event that you wish to cancel an order we must be informed in writing either by recorded delivery post to 83a Highfield Road, Blackpool, FY4 2JE or e-mail to toyshop100@btconnect.com. Should you wish to cancel within the 7 day period we will refund you the price you have paid for the products. This does not include the cost for delivery if you have cancelled after your order has been dispatched or the subsequent costs you may incur on returning the product to us. Should you wish to cancel before dispatch we will refund product cost and delivery charge. In the event that the customer has unsealed the packaging on a cd, dvd or audiotape the right to cancel no longer applies. You have a responsibility to return any cancelled products back to us unused and in the original packaging and condition with all wrappings and seal intact. You will be responsible for the returned product(s) until they reach us. We recommend using recorded delivery.

Returned products must be received back by us within 7 working days and costs will be refunded back by original method within 30 days. Once 28 days have lapsed if the product has not been received back the right to a refund will no longer apply.

Refund/Returns policy
In the event that an item arrives faulty, has been sent in error by us or is not as described you must notify us within 7 working days to qualify for a full refund, exchange or replacement. The above does not apply to faults or damage caused by wear and tear, accidental damage, neglect or misuse.

Refunds which have been granted will be issued via original method of payment within 30 days of cancellation or receipt of goods back to us.
